Customers can be charged up to £30 for becoming overdrawn without permission - an amount which a number of consumer groups and the Office of Fair Trading (OFT) believes is unreasonable.

As such, eight financial institutions - Abbey National, Barclays Bank, HSBC, Clydesdale Bank, HBOS, Lloyds TSB, Royal Bank of Scotland and the Nationwide Building Society - have been challenged by the OFT about the fairness of unauthorised overdraft charges.   The OFT argues that bank overdraft charges come under the jurisdiction of the 1999 Unfair Terms in Consumer Contracts Regulations legislation. If successful, this would mean that the office would have the authority to decide whether the charges are unjust and would have the power to force the financial institutions to change their practices.
